“Dacha Amnesty” can be extended

In the state Duma introduced a bill to extend until March 1, 2020, expiration of the so-called dacha Amnesty. If this bill will not become law in the coming days, from March 1, 2018, the Federal registration service will no longer accept documents from those who want to use a simplified procedure of registration of property rights, and for them, everything becomes more difficult and more expensive.

The law on “dacha Amnesty”, adopted in 2006, was offered the opportunity to register in a simplified manner properties, which the citizens have enjoyed for many years or even decades, but for some reason, to legalize them could not or did not want. It was received before the enactment in 2001 of the Land code land plots for keeping a personal subsidiary, country economy, truck farming, gardening, building personal garages or houses, and erected in these areas the buildings. The term “Amnesty” has been extended several times — the last time was in 2015 when I installed the current “day X” March 1, 2018.

In the explanatory note to the bill on prolongation of the term “Amnesty”, submitted signed by the head of the Duma Committee on state construction and legislation Pavel Krasheninnikov (United Russia), said: since 2006, in a simplified manner, there were more than 3.5 million objects of individual housing construction and more than 7 million land plots. Moreover, many provisions of the law on “Amnesty” was gradually transferred to the permanent laws that have simplified and normal procedure of registration.

Citizens complained about the high cost of services of cadastral engineers, and to alleviate this problem, several years ago, regions were given the right to set maximum prices for cadastral works on site. In the corresponding law of the Moscow region the maximum price is now determined in 450 roubles for a hundred, but not more than 7000 rubles per one land plot. In the Vladimir region, which is below: one “Amnesty” area — 4 thousand roubles, the two adjacent area — 7 thousand rubles, three adjacent plot of 7500 rubles. But the marginal price is also valid only until March 1, 2018.

What will change after that date, if “Amnesty” is not extended?

In addition to the inevitable rise in price cadastral services will have those who decide to register your apartment building. Until March 1, 2018 for the production on state cadastral registration of the ownership right on object of individual housing construction does not require permission to commissioning. And on March 1, the procedure will go on General rules, that is, within the building will require a permit for commissioning. In the absence of this document at home “will have signs of unauthorized construction and can be legalized only by a court order, which would complicate their introduction into the civil turnover,” reads the explanatory note. Thus in the construction of country houses of permits is no longer required by another law for them “Amnesty” actually became indefinite.

In conversation with “MK” g-n Krasheninnikov said that, “the exact number of houses whose owners have not yet taken advantage of the Amnesty, but potentially could, known, because of their state does not exist, but, according to some estimates, we are talking at least several hundred thousand.”

One of the reasons that encourages citizens not to register their property — taxes, which will have to pay in the event of legalization. “Here you have to choose: either the rights of property and related duties, or the prospect of inherited family problems”, — said the Deputy. In some cases, he said, to issue such property, received by inheritance, it turns out more expensive than the cost of the land or building, and sometimes impossible — if the title documents are lost, and where to find them, no one knows.

Can this bill be passed in the remaining before March 1, 2018 days?

The last before the presidential election the plenary meeting the state Duma will be held on 21 and 22 February. Mr. Krasheninnikov in conversation with “MK” expressed confidence that colleagues will support it, “because the need for the extension of the Amnesty understood by all”. Meanwhile, in the “EP” while this initiative has not been discussed — the head of the factional coordinating Council on legislative activities Andrey Isaev has told “MK” that “the issue will be considered at the Council meeting on Tuesday”. The official government position is also unknown.
