In the state Duma a bill that would ban the use of anonymous corporate SIM cards. The authors — a group of senators headed by Federation Council speaker Valentina Matvienko believes that this will help to deal more effectively with the use of mobile communications for criminal purposes in General, and telemarketing fraud in particular.

The explanatory Memorandum States that Russia is still “recorded cases” the sale of SIM cards without a contract on rendering of services of communication that is anonymous, “in places of a mass congestion of citizens” (railway stations, crossings, subway stations, etc.). Although current legislation envisages administrative liability for violations of this kind, the situation is not improving: in 2016, Roskomnadzor together with the Ministry of internal Affairs conducted 819 events, during which it had seized 28 516 illegally selling anonymous SIM cards (in the CFA — 10 227, in SZFO — 9168, UFO — 5536).
In 2013 the Code of administrative offences says the conclusion on behalf of the operator of the contract on rendering of services of mobile communication “an unauthorised person” penalty: for citizens — 2-5 thousand rubles, for officials — from 10 to 50 thousand rubles and for legal entities — from 100 thousand to 200 thousand rubles. Selling anonymous SIM cards without a contract and subscriber identity faces the same punishment. But in the recently held in the state Duma “round table” organized by the Committee on labor and social policy, said that has made from the sale of anonymous SIM cards present business people are using generally the same schema. Certain open company “Horns and hoofs”, a fictitious firm, or as a fictitious individual entrepreneur shall conclude a corporate contract with the service provider and legally get this way sometimes several hundred anonymous cards without reference to a specific user. One of the authors introduced in the state Duma of the bill, Senator Valery Ryazansky told “MK” that about a year ago during the “government hour” in the Federation Council with the participation of interior Minister Vladimir Kolokoltseva Valentina Matvienko has proposed to take a closer to the problem of the proliferation of anonymous SIM cards. “This is fraught with serious consequences — unfair people often use these SIM cards for nefarious purposes, such as contacting you in the organization of terrorist acts”, — said the Senator. Mr. Ryazan explains: “the concept of the bill was developed by Senator Lyudmila Side together with the interior Ministry, the Roskomnadzor and other supervising bodies. This concept is as follows: at the conclusion of corporate contracts for the provision of mobile communication services, including services for Internet access, the firm or entrepreneur will have to provide the operator with information about the user of each specific SIM card. To check the accuracy of the information, operators will have the opportunity to access some Federal information systems like Unified portal of public and municipal services, databases, Pension Fund or Fund of obligatory medical insurance. This, the authors say, will “counter the use of fraudulent passport data for the conclusion of contracts on rendering of services of mobile communication”.
It is expected that the new rules will enter into force on 1 January 2018.
The head of the Duma Committee on information policy, information technologies and communications Leonid Levin (“CP”) in conversation with “MK” called “current” problem, the solution of which is trying to offer the senators. In his opinion, the problem is, in fact, consists of two things: “the first legal sales of corporate cards without user registration, and the second is the need for more strict control over would-be business people who sell on the streets anonymous SIM card, purchased as a corporate that requires improving the performance of the police in this area”. The Committee “will carefully consider” the bill, promises g-n Levin.
