“The creation of the Institute of social courts is not an original proposal, a long-term, successful practice in many countries clearly identify the priority of consideration in courts of claims of citizens in need of protection of their rights in labor disputes,” he said.
According to Slepak, specialized judicial consideration of socio-labour disputes would strengthen the authority of the government, and will create additional opportunities for improving the social policy.
According to the text of the letter, the jurisdiction of the proposed judicial sector “should include all types of social, pension and medical insurance, state pensions, allowances and other guarantees of social protection and to ensure the protection guaranteed by the Constitution of the Russian Federation every citizen the right to social security in old age, in case of illness, disability, loss of breadwinner, for raising children and in other cases established by the legislation of the Russian Federation”.

OPINION: Vladimir, how did the idea to organize in Russia the social courts?
Vladimir Slepak: let’s Start with the fact that under the Constitution we are a social state. While recently there has been quite a strange and unacceptable pattern. I mean the battle for the social budget between economic and social units of the Russian government. Although Russia’s budget deficit, but I have already talked about how to rectify the situation, and even published 20 points on this topic. Or the tourism sector that creates millions of jobs, but no benefit to the state, which could bring. Instead, the economic bloc of the government looking to cut funding for the disabled and other socially vulnerable groups of citizens. Yes, we have a maternity capital and other support measures, but on the background of the prevailing inflation rate and the situation in the economy, these measures are insufficient.
OPINION: to protect socially vulnerable categories of citizens, you propose to organize the social courts?
V. S.: even If today there are no appropriate financial resources, why not confirm the social status of the state differently? Through administrative reforms and the creation of social courts. It is no secret that our courts are, perhaps, the most bureaucratic system. To take legal decisions on consumers. Only in 30% of cases, and even less make decisions about what consumer do the damage. V. S.: Issues requiring special attention, which I said should be resolved in the order stress, free and clear of any citizen of the system. That way, you can at least now, during the acute crisis, to show citizens that the government takes care of them. V. S.: I Think that in this case, the appropriate expression is: the end justifies the means. We in the Public chamber hotline on problems in the field of labor relations. And she had called about 7 thousand people! We are volunteers. Probably, from the state, but the volunteers must be responsible for the field people, those people will not be afraid to ask.
How are you going to bring your idea to the leadership of the country? And maybe someone has already responded to it: politicians, judges?
V. S.: I sent this idea to the Commissioner for human rights in Russia Ella Pamfilova. Given that she meets regularly with the President if it decides that the priority issue, then it can be considered at the highest level. And hope that someday they will become laws.
OPINION: Tell us a little about international experience. In some countries, the social courts already have?
V. S.: As a lawyer, I constantly monitor the situation. And I can say that such structures are successfully working in many, almost in all European countries. Germany, France, Denmark and others. There a few different mechanisms. Somewhere combined the socio-labour court, somewhere – a separate social and labor separately. But everywhere this issue is given special attention.
