The Prosecutor General of Ukraine accidentally declared Yanukovych the legitimate President

The Prosecutor General of Ukraine Yuriy Lutsenko again surprised everyone. He proudly reported that he was able to produce in the office of the UN a copy of the letter Yanukovych in March 2014, beckoning to Ukraine of Russian troops. In fact, the document hangs in the UN for three years. But the funny thing is not it.

“Lutsenko is not working logic”

On the eve of the Prosecutor General of Ukraine Yuriy Lutsenko has announced that it managed to “UN-recognized authentic” document that Yanukovych asked Russia to send troops to Ukraine. Obviously, Lutsenko didn’t know that the document was never a secret. As stated in the Russian version of the website of the United Nations, two days later, after writing – March 3, 2014 – a letter circulated at the UN, Russian Ambassador Vitaly Churkin, which is, for example, reported the press and the then Ukrainian counterpart Yuriy Sergeyev Churkin.

We will remind, on November 28, Lutsenko read out via video link suspected Viktor Yanukovych in violation of several articles of the Constitution and stated that the former President is suspected of treason. He did it using a technical break in the court hearing on another matter – about the shootings on the Maidan on which Yanukovych acted as a witness.

The fact that Lutsenko himself caught in a legal trap, 28 Nov noticed by his colleagues in the ruling coalition. “Incriminating Yanukovych of treason, Lutsenko is caught in a logical trap, – said the TV channel “112 Ukraine” Verkhovna Rada Deputy from “Blok Petro Poroshenko” Sergei Leshchenko. Otherwise, the actions of Yanukovych, it is a call to Putin, is just the call of an ordinary citizen, a natural person. And obviously it Putin should not in any way to respond. Then treason disappears,” – said the MP.

In addition, a colleague in the faction reminded the attorney General that he did not have the right to read the suspicion Yanukovych: “He, as the attorney-General had no right to read this document. Because he made Yanukovych a unique opportunity everywhere in the European court of human rights (to file) a complaint against Lutsenko”.

Serdyuk on Wednesday also reiterated that his allegations, the Prosecutor General acknowledged the fact that the March 1, 2014 Yanukovych was still the legitimate President. But, unlike a woman, he added, this fact casts doubt on the actions of the individuals who called themselves the “acting” President of Ukraine, and other temporary higher officials who assumed authority after February 22 of the same year. He insists that the meeting of the Council of national security and defense Council (NSDC) of Ukraine on 28 February 2014, to discuss the situation in Crimea, should be the key witnesses and maybe even suspects in the case.

“Everything, according to tradition, will end with the circus”

“If the case goes to court, you will receive an acquittal, the status of the current President and will be brought to justice the meeting of the Council held on 28 February 2014”, – said Serdyuk newspaper VIEW.

The lawyer is convinced that at the next meeting of Pechersky court of Kiev on January 20, during consideration of the petition of the Prosecutor General on charges of treason Yanukovych you must have a full picture of the events of February-March 2014.

The fact that the document has long been hanging at the UN, says nothing, protects Lutsenko, the Ukrainian political scientist, Director of the Center for political marketing Vasily Stoyakin. “To find it quite difficult. I doubt that the Prosecutor’s office of Ukraine has enough qualified personnel to handle the job. Plus the document posted on the website may not be valid in court. In Ukrainian law in court you can’t use even a notarized statement from the site. Therefore, the President needed the original”, – he explained the newspaper VIEW.

In any case, according to Stoyakin, knowing the peculiarities of Ukrainian judicial system, even if this case goes to trial, all according to tradition, will end with a circus, and no legal norms will not be complied with. “They lead the case against Yanukovych, accusing him of treason. But, as I recall, they offered to carry out a search in the administration of the President of Russia that as a whole characterizes this whole process is like a circus,” – said Stoyakin.

According to Stoyakina, it is difficult to say whether the exiled President to seek to enter into their country troops. “Violation of international law, such treatment is not treason – a question,” added the analyst.

“All courts are a sham”

Nestor Shufrich, a Deputy of the Verkhovna Rada from the Opposition bloc, former Deputy Secretary of the national security Council during the reign of Yanukovych complained that Ukraine has too many legal questions remain unanswered.

“Including the question of the legitimacy of the current Ukrainian authorities. “Interactive” process over Yanukovych, according to Shufrych, he will continue to go, attracting the attention of the public. However, says Shufrych, while both parties share a state border, all courts are a sham.
