The Spanish court decided to arrest Jiang Zemin, who led China before 2003

After eight years of preliminary investigation, the Spanish court ruled to arrest the former President of China Jiang Zemin and several other functionaries of the CPC in retirement. The reason is cultural and ethnic genocide of the Tibetan people. What exactly accuse Jiang Zemin, what are the prospects for his arrest and than it threatens the Spanish-Chinese relations, trying to figure out the VZGLYAD.
The Supreme court of Spain has issued a warrant for the arrest of high-ranking Chinese officials retired, including former Premier Li Peng, a former intelligence chief Qiao Shi, former Secretary of the Communist party in the Tibet Autonomous region Chen Kuyang, former Minister for family Affairs Peng Peiyun, and most importantly, former President of China and General Secretary of the CCP Jiang Zemin. Thus, if the named bosses cross the border of Spain or any country with which Spain has an extradition Treaty, they must be forcibly brought in for questioning in Madrid. Evidence proving their guilt, the court found sufficient, according to The Wall Street Journal. The Chinese are accused of nothing less than the organization of the genocide of the Tibetans. As follows from the statement “the injured party”, as a result of deliberate policy of the CCP has killed more than a million people, and about 90% of the shrines were destroyed.
The villain not the
The movement in support of Tibet is one of the most massive in the world movements of this kind, with significant resources and influential lobbyists. International network The International Tibet Network, numerous rallies in support of the Tibetans, scientists, proving the occupational nature of the Chinese authorities in Lhasa, millions of Buddhists, sympathizers from among the world’s celebrities (especially, of course, it is necessary to highlight Richard Gere), policy-makers and finally, the Dalai Lama XIV – they’re all part of it. The case in question, was accepted in 2006 with the filing of the Spanish supporters of Tibetan independence. Moreover, in the case were not only former Chairman of China but also the incumbent, Hu Jintao. However, to authorize his arrest, the court refused.
Recently, Hu Jintao left the highest office in the PRC, handing over power to XI Jinping. Of course, he retained some “residual effect”. But assuming that the national court of Spain was guided not by political deals, and the letter of the law (see below), ignoring the role of “comrade Hu” together with a warrant in the name of “comrade Jiang” side looks a bit strange.
The efforts of the PRC to suppress separatism in the Tibet Autonomous region are systemic in nature. The last mass demonstrations of the Tibetans against the policy of the CPC date back to 2008, then it was associated with the Olympics in Beijing and the anniversary of the exile of the Dalai Lama. Even more excitement occurred in 1987-1989, coinciding with the statements of supporters of democratization of China, the culmination of which were the events in Tiananmen square. In 2008 Jiang Zemin was a distinguished pensioner, 1987-1989 in charge of Shanghai (first by city, and then the local branch of the CCP). But Hu Jintao is not only headed the government in 2008, but was personally involved in the repression of protests in 1988-1989. In fact, the Secretary of the party Committee of the Tibet Autonomous region, he was appointed to suppress the rebellion.
At the end of January 1989 from a heart attack died, the Panchen Lama X (the second in the spiritual hierarchy of Tibetan Lama after the Dalai Lama), had recently arrived in autonomy. Many Tibetans still believe that the Panchen Lama was poisoned on the orders of Hu, fearing that he will lead a rebellion. A month after the death of the Lama boomed the largest revolt revolt, suppressed with the help of the army. Were killed, according to various estimates, from 40 to 450 Tibetans in the region was introduced a state of emergency. For the successful counter-insurgent comrade Hu commended the Deng Xiaoping. And only after the suppression of protests in Tibet and in Beijing the General Secretary of the CPC Central Committee took supported by the conservative Jiang Zemin.
If to speak about the period of the most severe repressive measures against Tibet, Tibetans and their culture, neither Jiang nor Hu deliberately not involved in them (not to mention involvement in Candoshi operations in 1950 in which Tibet lost its independence). So, the mass destruction of millenary temples and monuments of culture and art in the years of the “cultural revolution”. To prevent vandalism of the red guards was then decided a very few officials, but what was saved, preserved because of them (first and foremost it is worth noting the role of Zhou Enlai, who chaired the state Council; only the unique professionalism and popularity among the people and personal loyalty had saved him then from the wrath of Mao).
“Continue, if you have enough courage”
But back to Spain. After the death of Franco, the fall of the regime, Falangists and the beginning of democratic reforms, the state court of the Kingdom were given the right of universal jurisdiction in cases of crimes against humanity, in particular genocide (this was done, in particular, for more effective investigation of crimes of the Franco regime). The result was the initiation of a number of high-profile cases of an international character. It was in Spain order was issued for the arrest of Augusto Pinochet. Here considered the case in the Rwandan genocide, the bombing of Gaza by Israel, a number of cases against totalitarian regimes in South and Central America (Spain took a lot of refugees and migrants from these countries). Filed the state court prosecution and officials from the administration of George Bush, the Prime suspect in the torture and other violations of the rights of prisoners in Guantanamo Bay (the case is still under consideration).
At some point, Madrid are simply tired of intervening in other people’s tragedy and suffering costs from the inevitable quarrels with other countries, and in 2009 the powers of the court were limited. Since then, to consider this case, the court can only be the case if the victims of crimes against humanity are citizens of the Kingdom of Spain. However, the case against Jiang, Hu and other does not fall under this restriction as one of the plaintiffs Buddhist monk Thubten Wangchen is a citizen of Spain.
Official Madrid is clearly not happy that the court ruled to arrest honored Chinese party members. It is unlikely this would have actually followed the arrests, but the sanctions from China can follow. Yes, China is not important Spanish partners from the point of view of exports, and the share of Chinese goods in imports is slightly more than 6%. However, China has a number of Spanish firms, in addition, the economic impact of China now is very high, and Spain is among the most affected countries in Europe with huge foreign debt and soaring unemployment. Now the Kingdom needs Chinese investment and Chinese markets, and the extra political problems, in contrast, is not needed.
The Chinese foreign Ministry has already called the claims of the Spanish court was “absurd” and “groundless”, the attendant spoke on the inadmissibility of intervention in the internal Affairs of China. The Chairman of the Committee for ethnic and religious groups, Zhu Vacua responded not in the example worse. “If the court of any country to make such decisions, then he covers himself with shame,” – said the official. He added: “go on, if you have enough courage.”
Courage may not be enough, but the official Madrid has no levers of pressure on the court, and any interference in its activities is fraught with a major scandal in Spain and at the international level, given the extensive network of support for Tibetans. The atmosphere warms and the fact that since 2009, more than a hundred Tibetan monks have committed self-immolation in protest against the “policy of cultural genocide”.
About cultural genocide, perhaps, worth mentioning in more detail. The costs of Chinese domination are really great and not limited to the period of “cultural revolution”. Tibetans particularly concerned about the deliberate colonization of the region by ethnic Chinese (Han) with the aim to “blur” extremely religious and rebellious ethnic group. For some time Beijing is going to do to appoint the Dalai Lama through bureaucratic procedures, not really ignoring the spiritual beliefs of Buddhists on this issue.
On the other hand, Tibet to Candoshi operations – slave, in every sense of the backward and archaic state with an uneducated population that until recently practiced brutal torture and tax collection “on the nose and ears” (defaulters these bodies cut). With all objectively negative interventions in the cultural and religious component of the lives of Tibetans can not be denied and huge investments in the region of Beijing. Infrastructure, education, social services, rising standard of living, the abolition of archaic laws – all this credit goes to China. But despite this, fans of Chinese domination among Tibetans is still very little. As stated shortly before his death mentioned above Panchen Lama X, “thanks to China, of course, was a development, but the price paid for this development has been greater than the benefits”. And despite the fact that Panchen Lama X to that moment was not a dissident, as part of the Chinese elite – Deputy Chairman of vsekitajsky meeting of national representatives.
As for the distinguished retired Jiang Zemin, Hu Jintao and he enjoyed great influence and authority, but at the moment his “Shanghai clique” to move in the direction of the other groups. This, of course, means nothing: the attempted prosecution of a man who recently held the highest posts in the state and personified the whole Chinese regime would inevitably lead to strong opposition from resentful and vindictive, and China. It is characteristic that the governments of European countries in recent years, trying once again not to discuss the Tibetan issue.
