Amnesty of Ukrainian law enforcers in the Donbass will lead to a rise in crime

The decision of the Verkhovna Rada to grant Amnesty to its security forces in the Donbass will lead to a sharp rise in crime across Ukraine, which, according to the head of the National police Khatia Dekanoidze, from 2013 to 2016 and has increased by 30%. However, as shown by legislative and judicial practice in the Square, Kiev is at hand.

Over the past six months, the Verkhovna Rada adopted two laws that mitigate liability for crimes of any severity, up to removal from the courtroom. Most importantly, the criminal marked by the killings of supporters of the breakaway DNI and LC.

At the end of December 2015, the members voted and the President signed the so-called “law of Nadezhda Savchenko, which is 1 day in prison counts as 2 days in prison, whatever the crime was not committed by the person. As a result, freedom has left over 6 thousand people, including nearly 800 murderers and 600 drug traffickers and 3 thousand thieves of various stripes.

The second legislative initiative was the decision of 7 July Amnesty of those participants ATO who are engaged in theft, looting, or once he has committed a serious or especially serious crime in the Donbass. Under the Amnesty “for the” do not fall only deserters and soldiers who stole weapons and set fire to army property. For this decision at number 4255 voted 247 deputies. The adoption of the document was supervised personally by the speaker of the Verkhovna Rada Andriy Parubiy, who believes that “we need to support our boys in respect of whom criminal proceedings had been instituted”.

To the participants of combat actions in Donbas Ukraine has long had a special relationship. For example, June 10, Ivankov district court of the Kyiv region sentenced to 4 years conditionally and the penalty in 3 thousand hryvnias of a participant ATO, which in 2015 had raped a minor girl. According to the judge, the fighter deserved indulgence, so how to protect the country against the militia of Donbass. And he was not embarrassed that the crime occurred not on the front line, and in the village Mlachivka, 100 km from Kiev and 20 km from the Belarusian border.

A similar case occurred in early July, when prosecutors tried to prosecute one of the founders of the “Aydar” Valentine Likholit, a suspect in the robbery, torture and executions in the Donbass. Initially, the Kyiv Pechersk district court, relying on the testimony of co-workers Likholit, sent him to jail until August 28, but to bring the leader of the “aidarova” from the temple of Themis did not work, as the building was besieged by fans of “defender of the Motherland”. To defuse the situation to the Prosecutor General of Ukraine Yuriy Lutsenko had to say that his subordinates rushed to bring charges in the case still need to understand. After that, Liholaja was released on bail.

Why Dekanoidze closes on all these facts the eye, “MK” said Denis DENISOV, head of the Ukrainian branch of the CIS Institute:

First, the economic situation of course affects the growth of crime in Ukraine, but a much greater role in this played the position of authorities who are doing everything to ensure that the population lived with a constant sense of intimate danger. After all, the Ukrainians understand that, after law Savchenko and such Amnesty among them are repeat offenders who will not suffer any punishment for their crimes because they fought on the Donbass. Kiev is profitable, because fear helps to control people. Second, Dekanoidze can’t say that police reform did not take place, and seriously hurt the law enforcement bodies of Ukraine. New officers were selected not according to their level of training, and their Patriotic spirit. And if you follow the media reports, the crime rate in 2013 grew 30%, and several times more.

Is it possible to draw a parallel between the act of 7 July and Amnesty prescribed in the Minsk agreement?

No, because by the Minsk agreement, the punishment should avoid only those people who take part in the political life of the DNI and the LC and did not commit serious crimes. A Ukrainian variant on the one hand justifies war crimes in the Donbass, and on the other — does not apply to volunteers. People who now go free, to fully feel their impunity, and will return in the Donetsk and Lugansk regions, to continue to commit crimes.
