The head of the constitutional court Valery Zorkin said the decision on the trial by jury for women who were previously not permitted by law. According to Zorkin, quoted by “Interfax”, the Ukrainian MP Nadiya Savchenko, the court’s decision will not apply. Lawyers Savchenko ready to complain to the ECtHR.
Recall that today the COP has made the decision that recognized the discriminatory legislation that prohibited trial by jury for women, whereas it was allowed for men from 18 to 65 years.
Zorkin said that the ruling would apply only to those citizens whose cases have not yet reached court, while the process Savchenko is nearing completion (last session, under the assumption of lawyers, to be held in early March).
The lawyer Hopes Savchenko mark Feigin has said that he sees in this limitation of the right Savchenko cause for complaint: “Provide the grounds for the complaint Savchenko in connection with the decision of the COP. The hope of this decision, the COP will not help, but will help other women,” he wrote on Twiiter.
In addition, said Zorkin, the case is already before the court cannot be directed to the review by a jury. The only exception here may be a case of Alena Lymar, who sent his complaint to the constitutional court. It is her claim of lack of jury trial and granted the court.
Recall that limar were originally accused of manslaughter: her teenage daughter fell out of the crib to his death and hit the floor. However, subsequently, based on the testimony of her husband (at the time of the tragedy he was not yet) the case was requalified to article “Murder”.
